Terms of Service

These terms govern your use of Cadu, a WhatsApp-based website builder. By using Cadu, you agree to these terms, the Privacy Policy, and (where Cadu processes personal data on your behalf) the Data Processing Agreement, all of which form part of the contract between you and Cadu.

1. The service

Cadu lets you create and manage a website by sending WhatsApp messages. We use AI to interpret your instructions and apply changes to your site. Your site is hosted and served globally by Cadu.

2. Your account

Your Cadu account is tied to your WhatsApp phone number. You are responsible for any activity that occurs through your number. Do not share access to your WhatsApp with people you don't trust to manage your site.

4. Your content

You own the content you create with Cadu. We do not claim any ownership of your website content, text, or images. We need a licence to host and serve your content in order to provide the service, which you grant by using Cadu.

5. AI-generated content

Cadu uses AI to generate and modify your website content based on your instructions. While we strive for accuracy, AI may occasionally produce errors. You are responsible for reviewing your site and ensuring the content is correct before relying on it.

6. Pricing and payments

Cadu offers a free trial and paid plans. Prices are displayed on our website and may change with notice for future billing periods. The Cadu Solo subscription is available with either monthly billing or annual billing (at a discount); you choose at checkout. You can cancel at any time.

Payments are processed by Dodo Payments, who acts as merchant of record. Dodo handles invoicing, tax, and refunds on our behalf, and will appear as the merchant on your bank or card statement. Local currency conversion and applicable tax are shown at checkout.

Refund policy: you may request a full refund within 7 days of any new subscription purchase, no questions asked, by emailing billing@cadu.app. Refunds outside this window are handled on a case-by-case basis in accordance with applicable consumer protection law. One-time top-up purchases (extra edits) are non-refundable because the credits are applied to your account immediately.

For any billing question — invoices, refunds, failed payments, switching between monthly and annual, or cancelling — email billing@cadu.app and we'll respond within one business day.

7. Availability

We aim to keep Cadu and your website available at all times, but we do not guarantee 100% uptime. We are not liable for any downtime or data loss, though we take reasonable measures to prevent both.

8. Data protection

When Cadu processes personal data on your behalf — for example, when visitors to your website submit contact forms or other personal information — Cadu acts as a data processor and you act as the data controller. The terms of that processing relationship are set out in the Data Processing Agreement, which is incorporated into these Terms by reference. By accepting these Terms, you accept the DPA.

You are responsible for ensuring that your website complies with applicable data protection law, including by providing visitors with a privacy notice that accurately describes how their data is handled. Cadu can help you generate such a notice, but you remain responsible for its accuracy.

9. Termination

You can stop using Cadu at any time. To cancel your subscription, either ask the Cadu assistant on WhatsApp to cancel it for you, or email billing@cadu.app. Cancellation takes effect at the end of your current billing period — you keep access to edit your site until then.

After the billing period ends, your site remains live for a 7-day grace period during which you can resubscribe instantly. After that your site is replaced by a parking page, but your work is saved and can be brought back any time you resubscribe. Your site files and data are retained for 30 days from cancellation before permanent deletion, except where retention is required by law.

We may terminate your account if you materially violate these Terms. In that case we will give you reasonable notice where practicable.

10. Limitation of liability

Cadu is provided "as is". To the maximum extent permitted by law, we are not liable for any indirect, incidental, or consequential damages arising from your use of the service. Nothing in these Terms limits any liability that cannot be limited by applicable law, including liability for death or personal injury caused by negligence, fraud, or fraudulent misrepresentation.

11. Governing law

These Terms are governed by the laws of Romania. Disputes shall be subject to the exclusive jurisdiction of the Romanian courts, without prejudice to any mandatory consumer protection rights you may have in your country of residence.

12. Changes to these terms

We may update these terms from time to time. If we make significant changes, we'll notify you via WhatsApp. Continued use of Cadu after changes constitutes acceptance.
